Dispute Resolution

Rachlis Neville is available to provide customized dispute resolution services, to assist parties and teams in avoiding and resolving conflict. Keeping in mind a range of process design considerations, Vivian and Elissa work with clients to consider and craft appropriate interventions, many of which can be employed before proceeding to investigation. Some of the services we provide are described further below.

Workplace Assessments, Environmental Scans

Workplace assessments or environmental scans are a means of proactively identifying and responding to potential workplace concerns, including concerns about workplace culture and practices.

We are available to conduct—or assist clients in conducting—assessments of work environments. These may involve some or more of the following: individual interviews, questionnaires, focus groups, reviews of policies, practices, procedures, legislation or other relevant materials. Typically, we will collect information and data about the work environment, identify workplace challenges, and provide recommendations for next steps. We provide advice in both unionized and non-unionized contexts, always working with processes and stakeholders already in place.

Working with our client, we can customize our reports to include information that will be most helpful for improving the work environment and can assist in identifying any necessary follow up steps or resources.

Mediation

Mediation is a voluntary and collaborative process, which aims to see participants actively contributing to reaching mutually satisfactory outcomes. Incorporating a fair and balanced third-party neutral into a dispute resolution process can assist in building trust and enhancing understanding.

Communication skills—while essential to all dispute resolution professionals—are a cornerstone of any mediator’s practice. The mediator uses influence, not authority, to help move the parties towards resolution. As mediators we bring not only strong listening and questioning abilities, but the skill and emotional intelligence to help parties communicate with one another.

Other available services include:

  • Facilitated discussions
  • Arbitration
  • Hybrid processes (eg. Med-Arb, mediation-investigation)
